The Central Bureau of Investigation (CBI) has filed chargesheet against former Railway Minister Lalu Prasad Yadav, his wife Rabri Devi, son Tejaswi Yadav and 11 others in connection with the IRCTC Scam.

The former Bihar Chief Minister Lalu Yadav was questioned last year by the agency in connection with the case. Rabri Devi's statement was recorded by CBI recently in connection with the case.

CBI grilled Bihar's former Deputy Chief Minister, Tejaswi Yadav who was chargesheeted for the first time by agency.

Out of the total 14 people named in the chargesheet, 8 were named initially and six were added later by the agency.

The CBI on July 5 filed a corruption case against Lalu Prasad, his wife Rabri Devi and son Tejashwi Yadav for alleged irregularities in the allotment of contracts for IRCTC hotels in Ranchi and Puri in 2006 to a private firm when the RJD chief was the Railways Minister.

Sarla Gupta (wife of Prem Gupta), Vinay and Vijay Kochchar (owner of Hotel Chankaya), PK Goel, then IRCTC managing director PK Goel, Prem Gupta (close aide of Lalu Yadav), Rakesh Saxena, then director of IRCTC , BK Aggarwal, present additional member Railway Board (the then group general manager IRCTC) have been chargesheeted by the CBI.

IRCTC was created by railways in 1999. In 2001, it was decided that management of catering services including hotel properties will be given to IRCTC.

An MoU was signed, wherein the management of two hotels, one in Ranchi and the other in Puri was handed over to IRCTC. This MoU was signed in March 2004.

Lalu was sworn in as Railway Minister in May 2004. CBI alleged that once Lalu Yadav took charge of the office, he entered into a criminal conspiracy with Kochars, Sarla Gupta.

The CBI had, on July 5, filed a corruption case against Lalu Prasad, his wife Rabri Devi and Tejashwi Yadav for alleged irregularities in the allotment of contracts for Indian Railway Catering and Tourism Corporation ( IRCTC )

Earlier last week, the CBI registered a corruption case against Lalu , his wife Rabri Devi , son Tejaswi; former Indian Railway Catering and Tourism Corporation ( IRCTC ) Managing Director P.K. Goyal; and the wife of Lalu 's confidante Prem Chand Gupta

Conspiracy

On February 25, 2005, Kochars sold commercial property measuring 3 acres to Delight Marketing for Rs 1.47 crore.

The director of Delight Marketing was Sarla Gupta, the wife of Prem C Gupta.

CBI claimed Sarla Gupta is a benami holder for Lalu Prasad Yadav. The Rs 1.47 crore deal was allegedly much below the then circle rate and market rate. Also, the commerical plot was shown as an agricultural land to evade stamp duty.

CBI further alleged that Bikramjeet Singh Ahluwalia promoter of Ahluwalia Contracts bought shares of a shell company, Delight Marketing Private Limited, and this is how Delight Marketing purchased the land.

Further investigation revealed that the day Kochars sold the land to Delight Marketing (February 2, 2005), the Railway Board informed IRCTC that BNR Hotels are being transferred to IRCTC.

As soon as this was done, Lalu Yadav and PK Goel got two BNR hotels transferred to Sujata/Chankaya Hotels through a rigged and manipulated tender process.

CBI claimed that Lalu Prasad as Railway Minister was aware of the whole matter and was keeping a track of the tender proceedings initiated by IRCTC.

Between 2010-2014, Lalu's family virtually took over Delight Marketing. The circle rate of the property was Rs 32.5 crore whereas the market rate was Rs 94 crore.

CBI said that the shares of Delight Marketing net worth of around Rs 32.5 crore, in form of real estate, was sold by PC Gupta family to Yadav family members for Rs 64 lakhs.
